Resolution 1997-8 of the Real Estate Council of Alberta

WHEREAS pursuant to section 84(1) of the Real Estate Act, S.A. 1995, c. R-4.5 (the “Act”), the Real Estate Council of Alberta (the “Council”) has the power, duty and responsibility to amend or appeal bylaws and rules.

THEREFORE BE IT RESOLVED THAT:

Rule 54 be amended from:

54 The advisory board, in the case of an insurance or indemnity plan referred to in section 52, or the administrator of the group insurance plan, in the case of a group insurance plan referred to in section 48, shall

(a) Immediately on becoming aware of a contravention by an agent, designated representative or salesperson of these Rules or a term or condition of an insurance or indemnity plan or group insurance plan

(i) notify the agent, designated representative or salesperson who is in contravention, and

(ii) where a designated representative or salesperson is in contravention, notify the agent who employs the designated representative or salesperson

of that fact, and

(b) immediately notify the Council of any contravention referred to in clause (a) that is not remedied within 30 days after notification is given under that clause.

54 The advisory board, in the case of an insurance or indemnity plan referred to in section 52, or the administrator of the group insurance plan, in the case of a group insurance plan referred to in section 53(1), shall

(a) Immediately on becoming aware of a contravention by an agent, designated representative or salesperson of these Rules or a term or condition of an insurance or indemnity plan or group insurance plan

(i)  notify the agent, designated representative or salesperson who is in contravention, and

(ii) where a designated representative or salesperson is in contravention, notify the agent who employs the designated representative or salesperson.
