Hearings Information & Procedures

Hearings and appeal proceedings are formal processes, similar to court proceedings, to determine if a licensee has engaged in conduct deserving of sanction.

Hearing panels consider evidence in deciding whether a licensee’s conduct is deserving of sanction under the Real Estate Act or Rules. A hearing panel has the right to question witnesses under oath and it has many of the powers of the court for the trial of civil actions.

Appeal panels consider appeals of a decision of a hearing panel. Appeal panels can uphold, modify, or quash decisions made by a hearing panel or refer the matter back to the hearing panel for further consideration.

Every hearing and appeal panel must have at least three members, including:

  • at least one licensee
  • at least one member of the public (with the number of public members not exceeding the number of licensee members)

Hearing Panel Roster Opportunities


RECA is looking for three public members to join its hearing panel roster. Roster members serve as decision makers as part of hearing panels and appeal panels under the Real Estate Act.

Qualified public member applicants should have:

  • at least 5 years’ experience as an administrative law decision writer and preferably be a member of the Law Society of Alberta
  • sound judgment, tact and diplomacy
  • outstanding integrity
  • ability to make and write tribunal decisions
  • excellent written communication skills
  • administrative law knowledge is required
  • past experience as a tribunal decision maker is an asset
  • understanding of industry practice in one or more of real estate, mortgage, property management or condominium management would be considered an asset
Service Term and Remuneration

The appointment may be up to three years with the possibility of an additional three year term. Panel members are paid a fee and reimbursed for reasonable expenses for sitting on hearing and appeal panels based on RECA Board of Directors approved rates.

RECA is looking for three residential real estate licensees (brokers, associate brokers, or associates) to join its hearing panel roster. Roster members serve as decision makers as part of hearing panels and appeal panels under the Real Estate Act .

Qualified residential real estate licensee applicants should have:

  • at least 5 years of residential real estate and/or residential property management industry experience
  • excellent understanding of residential real estate and/or residential property management practice and standards
  • sound judgment, tact, and diplomacy
  • outstanding integrity
  • ability to analyze, and make findings of fact and breach
  • excellent communication skills
  • administrative law knowledge and past tribunal experience are assets
