Resolution 1998-2 of the Real Estate Council of Alberta

WHEREAS by Rule 69.1 of the Real Estate Act, S.A., c. R-4.5, the Real Estate Council of Alberta (the "Council") has the power, duty and responsibility to prescribe, adopt and approve the form for and information contained in the Declaration Respecting Absence of Trust Transactions to be filed with the Council by an agent who receives no money on the account of others in the course of his business.


THEREFORE BE IT RESOLVED THAT:
  The Council hereby prescribes, adopts and approves the form attached hereto as Schedule "A" and the information contained therein as the form and information required for the Declaration Respecting Absence of Trust Transactions to be filed with the Council by an agent who receives no money on the account of others in the course of his business

DECLARATION RESPECTING ABSENCE OF TRUST TRANSACTIONS

THAT for the fiscal year ended _________________, 19____, I have not received any trust money in the course of carrying on business as a real estate agent.

THAT I make this declaration for the purpose of being exempted from the requirement in Section 25 of the Real Estate Act to account to the Executive Director, Real Estate Council of Alberta.

THAT I understand that, if after making this declaration, I receive trust money in the course of my business as a real estate agent, the exemption expires and I must account to the Executive Director, Real Estate Council of Alberta, as required by the Real Estate Act , and its Rules and Regulations.

AND I make this declaration conscientiously believing it to be true and knowing that it is of the same force and effect as if made under oath.
