Resolution 1998-6 of the Real Estate Council of Alberta

WHEREAS by Rule 19(1) of the Real Estate Act, S.A., c. R-4.5, as amended (the “Act”), the Real Estate Council of Alberta (the “Council”) may prescribe, adopt or approve

(a)educational requirements that must be met by an applicant for an authorization,

(b)the requirements for continuing education for industry members, including educational requirements that must be met prior to the issuance of a renewal of an authorization, and

(c)examinations for the purposes of Section 7.

THEREFORE BE IT RESOLVED THAT:

The Council hereby approves Real Estate 1000, or equivalent, as a prerequisite to the Real Estate Agent’s Licensing Program effective January 1, 1999. This Policy is an adjunct to Resolution 960014 dated the 21st August 1996.

1.Terms that are defined in the Act and Rules have the same meaning when they are used in this Policy.

2.A person wishing to obtain a licence as a real estate agent must fulfill the education requirements of Real Estate 1000 and pass a Provincial Qualifying Examination as a prerequisite to enrolling in the Real Estate Agent’s Licensing Program.

3.The Executive Director shall have the responsibility for approving the course outline, course objectives and lesson plan (consisting of a set of topics and the amount of time allocated to each topic) for Real Estate 1000.

4.By Resolution dated July 9, 1996, the Council delegated to the Executive Director the responsibility for approving the Provincial Qualifying Examination for Real Estate 1000 and the passing grade for this examination.

5.The Executive Director may grant an exemption:

(a)from the Real Estate 1000 and the Provincial Qualifying Examination in accordance with Section 7 of the Rules, or

(b)from Real Estate 1000 if, in the opinion of the Executive Director, a candidate has already taken an equivalent course or courses.

6.Candidates who successfully challenge the Provincial Qualifying Examination will be subject to the same policies as candidates who successfully complete the Real Estate 1000 course.

7.The Executive Director shall issue a Certificate of Completion to candidates who successfully complete Real Estate 1000.

8.To be eligible for a Certificate of Completion, candidates must attend 90% of the classes in Real Estate 1000 or meet the attendance requirements of the education institution delivering this course, whichever is greater.

9.The Executive Director shall issue a Permission to Write the Provincial Qualifying Examination to candidates who have qualified for a Certificate of Completion for Real Estate 1000.

10.Candidates must present their Permission to Write and an acceptable picture identification to obtain entrance to the Provincial Qualifying Examination.

11.(a)Candidates who fail to attain a passing grade on the Provincial Qualifying Examination may rewrite this examination two more times upon payment of the prescribed fee.

(b)The Executive Director shall issue a Permission to Re-write to candidates who wish to re-write and have paid the prescribed fee.

12.A Permission to Write is valid for one year from the date of issue, and a Permission to Re-Write is valid for sixty days from the date of issue.

13.Candidates who fail to attain a passing grade on the Provincial Qualifying Examination on three attempts are required to re-register and complete the course requirements of Real Estate 1000 before they can re-write the Provincial Qualifying Examination again.

14.Refund of course fees for failing to complete Real Estate 1000 are at the discretion of the educational institution delivering this course.

15.The prescribed fee to re-write the Provincial Qualifying Examination is $50.00.

16.(a)An administrative fee of $50.00 must accompany every application for an exemption pursuant to paragraph 5.

(b)With an exemption from Real Estate 1000, the fee for writing the Provincial Qualifying Examination and course materials is $300.00.
